One dead in Casselberry shooting

An 18-year-old Altamonte Springs man was shot and killed following an altercation early today in Casselberry. Police believe it began as a drug rip-off and escalated into an argument with both sides of the argument being armed, Casselberry police Lt. Scott Pleasants said.

The victim, Kelvin Batista, was shot with a .40-caliber rifle that was recovered by police, Pleasants said.

The shooting occurred about 1:40 a.m. at the Cassel Creek Townhomes off Derbyshire Circle, Pleasants said. Two men are being questioned and both were arrested for violating probation, but neither is being charged in the shooting death at this time, Pleasants said.

A decision to made a more thorough review of the case before making arrests came after consulting with the Seminole-Brevard State Attorney’s Office. One of the men, Kyle Tomascak, 19, lives in the complex where the shooting occurred, Pleasants said. He identified the other man as Barry Kinnan, 21. Tomascak is suspected of being the shooter, Pleasants said.

Kinnan was apprehended at a business on State Road 436, Pleasants said. Tomascak called police and then voluntarily returned to the scene, he said.
